The defendant-appellant, Robert Charles Sparks, was indicted for first degree murder in the shooting death of his niece, Jeannie Lee Sanders. The jury found him guilty of second degree murder, and he was sentenced to twenty years in the state penitentiary. On appeal the defendant raises multiple assignments of error, the most serious of which concerns the prosecutions closing argument to the jury. Because we find reversible error on this ground, the case must be remanded for a new trial on the second degree murder charge.
